泰州市区域供水水源和供水设施保护管理暂行办法

　　泰兴市、姜堰市、海陵区、高港区人民政府，市各有关部门（单位）：

　　《泰州市区域供水水源和供水设施保护管理暂行办法》已经市政府第19次常务会议通过，现印发给你们，请认真遵照执行。

泰州市区域供水水源和供水设施保护管理暂行办法

第一条 为加强泰州市区域供水水源和供水设施的保护，有效地控制环境污染对饮用水源的危害，保护人民身体健康，促进经济发展，确保供水企业安全和正常生产，根据《中华人民共和国环境保护法》、《中华人民共和国水法》、《中华人民共和国水污染防治法》、《江苏省城镇供水资源管理条例》、《江苏省人民代表大会常务委员会关于加强饮用水源地保护的决定》等法律法规，制定本办法。

第二条 本办法适用于泰州市区域供水（泰州市第三自来水厂）水源保护区范围及输水管线覆盖地区、专用的架空电力线路保护区。

本办法所称区域供水，是指跨行政区域实施城市供水；所称供水设施，是指区域供水所涉及的由泰州市第三自来水厂至泰州市二水厂东门水厂、泰兴市杨庄水厂、姜堰市第二自来水厂用于引水输水的设备设施及辅助设施。包括：引水管道、水表井、输水管道、阀门、排气阀、输电设施（含线路、电线杆塔、接地装置）、取水口专用浮标、取水口、各项取供水构、建筑物、各类管道支墩、阀门井、各种标志及水源地保护区封闭设施等。

第三条 一切单位和个人都必须遵守本办法，都有权对污染水源和破坏供水设施的行为进行监督和举报。

第四条 水源保护区设置水源一级保护区、二级保护区和准保护区，各保护区界应设置明显的标志和严禁事项的告示牌。

（一）一级保护区水域范围为：取水口上游1000米至下游1000米，向对岸500米至本岸背水坡之间的水域。一级保护区陆域范围为：一级保护区水域与相对应的本岸背水坡堤脚外100米之间的陆域。

（二）二级保护区水域范围为：一级保护区以外上溯2000米、下延500米的水域。二级保护区陆域范围为：二级保护区水域与相对应的本岸背水坡堤脚外100米之间的陆域。

（三）准保护区水域范围为：二级保护区以外上溯2000米、下延1000米的水域。准保护区陆域范围为：准保护区水域与相对应的本岸背水坡堤脚外100米之间的陆域。

第五条 在水源准保护区内，禁止下列行为：

（一）新建、扩建排放含持久性有机污染物和含汞、镉、铅、砷、硫、铬、氰化物等污染物的建设项目；

（二）新建、扩建化学制浆造纸、制革、电镀、印制线路板、印染、染料、炼油、炼焦、农药、石棉、水泥、玻璃、冶炼等建设项目；

（三）排放省人民政府公布的有机毒物控制名录中确定的污染物；

（四）建设高尔夫球场、废物回收（加工）场和有毒有害物品仓库、堆栈，或者设置煤场、灰场、垃圾填埋场；

（五）新建、扩建对水体污染严重的其他建设项目，或者从事法律法规禁止的其他活动。

在水源准保护区内，改建项目应当削减排污量。

第六条 在水源二级保护区内除禁止第五条规定的行为外，禁止下列行为：

（一）设置排污口；

（二）从事危险化学品装卸作业或者煤炭、矿砂、水泥等散货装卸作业；

（三）设置水上餐饮、娱乐设施（场所），从事船舶、机动车等修造、拆解作业，或者在水域内采砂、取土；

（四）围垦河道和滩地，从事围网、网箱养殖，或者设置集中式畜禽饲养场、屠宰场；

（五）新建、改建、扩建排放污染物的其他建设项目，或者从事法律法规禁止的其他活动。

在饮用水水源二级保护区内从事旅游等经营活动的，应当采取措施防止污染饮用水水体。

第七条 在水源一级保护区内除禁止第五条、第六条规定的行为外，禁止新建、改建、扩建与供水设施和保护水源无关的其他建设项目，禁止在滩地、堤坡种植农作物，禁止设置鱼罾、鱼簖或者以其他方式从事渔业捕捞，禁止停靠船舶、排筏，禁止从事旅游、游泳、垂钓或者其他可能污染饮用水水体的活动。

第八条 自来水供水企业对其管理的供水源、取水口、引水管道、泵站、输（配）水管网等设施，应当定期检查维修，确保安全运行。

第九条 严禁在区域供水输水管线及其附属设施的地面和地下的安全保护范围内，挖坑取土或者修建建筑物、构筑物等危害供水设施安全的活动，以及有碍输水管线运行、检修的活动。

第十条 严格对水厂道路和管道红线两侧各5米范围内的地段进行规划控制，不得搭建建筑物和构筑物，不得进行危害供水设施安全的活动。

第十一条 严禁在水厂专用的供电线路上搭接用于生产、生活需求的电力线路，确保专线专用；严禁在高压线路下兴建建筑物、构筑物和厂房；严禁在电线杆安全保护范围内进行挖坑取土等有害于线路运行安全的活动。

第十二条 市建设、水利、环保、渔业、交通（港口）、海事、供电、公安、经贸等部门和姜堰市、泰兴市、高港区、海陵区政府以及水源保护区沿岸的乡镇政府应按照各自的职责，切实做好三水厂水源和供水设施保护的实施和监督管理并协助做好输水管线维修等矛盾的协调工作。

市建设部门负责对三水厂水源和供水设施保护的监督、管理。主要职责是：

（一）制定三水厂水源保护规划；

（二）监督、检查水源保护的实施情况；

（三）会同有关部门做好水源保护区建设项目环境管理的监督、检查工作。

市水利部门负责对水源保护区地段河床监测分析和江堤维护工作的监督检查和指导及排污口的监督审批以及对在饮用水源保护区河道管理范围内建设妨碍行洪的建筑物、构筑物，或者从事影响河势稳定、危害河岸堤防安全和其他妨碍河道行洪的活动行为的查处。

市环保部门负责对水源保护区内各类新建工程实行环境影响评价，防止新污染源产生；对已有的污染源防治设施实施监督管理，定期对水源保护区水质和污染源排污情况进行监督监测。

渔业主管部门负责调查处理渔业船舶造成污染事故的调查处理。

市交通（港口）部门负责对码头及沿岸靠泊装卸作业点污染饮用水源的防治实施监督管理。

海事部门负责对船舶污染饮用水源的防治实施监督管理。

市供电部门负责专用电力线路的管理和维护。

自来水供水企业根据国家和省有关规定负责对水源进行检测和供水设施保护管理的日常工作。

泰兴市、姜堰市、高港区、海陵区人民政府应把三水厂水源保护、防治污染和供水设施保护作为一项重要任务，负责协助市各职能部门对本办法的贯彻实施。

高港区人民政府负责水源保护区沿岸江堤的保护和加固及封闭工程维护管理，保证厂区不受长江水淹，确保正常供水。

第十三条 临近水源保护区和水源保护区内的单位发生突发性污染事故，对水源造成或可能造成污染时，事故责任者应立即采取措施，消除污染，并报告卫生、环保、城建、水利等部门单位。有关部门应及时采取强制应急措施，责令排污单位立即停止排放污染物，消除或减轻损失和危害。

第十四条 凡违反本办法有关规定的，由市或所在市（区）有关行政管理部门通报批评、责令改正，并依据有关法律、法规和规章的规定给予行政处罚。

第十五条 违反本办法，在饮用水水源一级保护区内设置排污口，新建、改建、扩建与供水设施和保护水源无关的建设项目、设施；在饮用水水源二级保护区内设置排污口，新建、改建、扩建排放污染物的建设项目、设施；在饮用水水源准保护区内新建、扩建对水体污染严重的建设项目、设施，或者改建项目未削减排污量的，由县级以上地方人民政府责令拆除、关闭或者搬迁，并由县级以上地方人民政府或者其环境保护、水行政主管部门依照法律、法规的规定给予处罚。

本办法实施前，饮用水水源一级保护区内已建的与供水设施和保护水源无关的建设项目、设施以及饮用水水源保护区内的排污口，应当自本办法施行之日起一年内拆除、关闭或者搬迁。饮用水水源二级保护区内已建的排放污染物的建设项目和设施；饮用水水源准保护区内已建的对水体污染严重的建设项目和设施，其污水不能达标排放或者不能截入污水集中处理设施的，应当在本办法施行之日起两年内拆除、关闭或者搬迁。具体工作由县级以上地方人民政府组织实施。

第十六条 违反本办法，有下列行为之一的，由环保、水利、渔业、港口等部门或者海事管理机构根据各自职责，责令停止违法行为，并依照下列规定给予处罚：

（一）在饮用水水源保护区和准保护区内建设废物回收（加工）场、有毒有害物品仓库、堆栈，设置煤场、灰场、垃圾填埋场，在饮用水水源保护区内从事危险化学品装卸作业或者煤炭、矿砂、水泥等散货装卸作业的，处以三万元以上十万元以下罚款；

（二）在饮用水水源保护区和准保护区范围内排放省人民政府公布的有机毒物控制名录中确定的污染物的，处以五万元以上二十万元以下罚款；

（三）在饮用水水源二级保护区内从事围网、网箱养殖的，拆除违法设施，处以三千元以上一万元以下罚款；

（四）在饮用水水源一级保护区内滩地、堤坡种植农作物，设置鱼罾、鱼簖或者以其他方式从事渔业捕捞，或者停靠船舶、排筏的，处以一千元以上五千元以下罚款。

第十七条 县级以上地方人民政府不依法履行职责，造成饮用水源安全事故的，由上一级人民政府给予通报批评，并对主要负责人依法给予行政处分。

县级以上地方人民政府及其有关部门有下列情形之一的，对直接负责的主管人员和其他直接责任人员依法给予行政处分：

（一）相邻行政区界断面出境水质超过地表水（环境）功能区划规定的水质保护目标，未向上级人民政府报告或者未向下游地区县级人民政府通报的；

（二）违法审批建设项目的；

（三）未按本办法规定责令拆除、关闭或者搬迁建设项目、设施的；

（四）发生水污染事故及自然灾害等紧急情况，影响正常供水时，未采取紧急措施或者未及时向社会公布信息的；

（五）其他滥用职权、玩忽职守、徇私舞弊的行为。

第十八条 违法国家法律规定，造成重大水污染事故，严重破坏供水设施，影响供水生产，导致公私财产重大损失或者人身伤亡的严重后果的，对有关责任人员按照刑法的有关规定，由司法机关追究刑事责任。

第十九条 本办法未尽事宜，由市建设、环保、水利等部门会同泰兴市、姜堰市、高港区、海陵区人民政府、市经济开发区管委会商定。

第二十条 本办法自发布之日起施行。1999年6月24日泰州市人民政府发布的《泰州市第三自来水厂水源和供水设施保护管理暂行办法》同时废止。

各省、自治区、直辖市卫生厅局、中医药管理局：

　　为认真贯彻《中共中央 国务院关于进一步加强农村卫生工作的决定》，根据农村中医工作新形势、新任务，在全国农村中医工作先进县（市、区）建设的基础上，我局将开展全国农村中医工作先进市（地）建设工作。现将《全国农村中医工作先进市（地）建设标准与评审细则》印发给你们，请按照《全国农村中医工作先进市（地）建设标准与评审细则》开展全国农村中医工作先进市（地）建设工作，切实加强农村中医药工作。
